Terms & Conditions – CoMoGo

Welcome to CoMoGo – Food Multi Restaurant & Food Delivery App (“App”, “we”, “our”, “us”).
By accessing or using the CoMoGo mobile application, you agree to comply with and be bound by these Terms & Conditions.
If you do not agree, please do not use the app.
1. User Types
CoMoGo is used by three types of users:

Customers – ordering food

Restaurant Partners – preparing food

Delivery Partners (Delivery Man) – delivering orders
Each user must follow the rules applicable to their role.
2. Eligibility

Users must be at least 18 years old
-
Delivery Partners must hold valid driving documents (if applicable)

Restaurants must have valid business permissions/licenses as required by law
3. Account Registration

Users must provide accurate and complete information
-
You are responsible for maintaining account confidentiality
-
CoMoGo reserves the right to suspend or terminate accounts for misuse or false information
4. Orders & Payments
Customers
-
Orders once placed cannot be cancelled after restaurant confirmation (unless allowed by the restaurant)

Prices, taxes, and delivery charges are shown before checkout
-
Refunds (if any) are subject to restaurant and CoMoGo policies
Restaurants
-
Restaurants are responsible for food quality, hygiene, pricing, and preparation time
-
CoMoGo is not responsible for food quality issues
5. Delivery Services
Delivery Partners

Delivery Partners must keep location services enabled while on duty
-
Timely and safe delivery is mandatory
-
Misconduct, order tampering, or misuse of customer data may lead to permanent account termination
📍 Location tracking is required for order assignment and live delivery tracking.
6. Cancellation & Refund Policy

Cancellations depend on restaurant acceptance status
-
Refunds, if applicable, are processed through the original payment method
-
CoMoGo reserves the right to deny refunds in case of misuse or fraud
7. User Responsibilities
Users must NOT:

Provide false or misleading information
-
Abuse delivery partners, restaurant staff, or customers
-
Misuse the app for illegal activities
-
Attempt to hack, reverse engineer, or manipulate the app
8. App Availability

CoMoGo does not guarantee uninterrupted access

We may suspend or update services without prior notice

Technical issues, network failures, or maintenance may cause downtime
9. Limitation of Liability
CoMoGo shall not be liable for:

Food quality or hygiene issues

Delays caused by restaurants, traffic, weather, or force majeure

Losses arising from user negligence or misuse
-
Indirect or consequential damages
10. Termination
CoMoGo reserves the right to:

Suspend or terminate accounts without notice

Remove users who violate policies or laws
-
Block access for repeated complaints or fraudulent behavior
11. Privacy
Your use of the app is also governed by our Privacy Policy.
Please review it to understand how we collect and use your data, including location data for delivery partners.
12. Intellectual Property

All content, logos, designs, and software belong to CoMoGo

Users may not copy, modify, or distribute any part of the app without permission
13. Governing Law
These Terms & Conditions are governed by the laws of India.
Any disputes shall be subject to the jurisdiction of local courts.
14. Changes to Terms
We may update these Terms & Conditions from time to time.
Continued use of the app means you accept the updated terms.
